Where Do You Stand? Protecting Filmmakers’ Rights

At EntertainOne, we want to ensure all the titles we publish are legitimately available for distribution and sale. That’s why we insist that all producers have all necessary copyrights and proof of ownership, and why we refuse to offer service to those wishing to infringe on others’ intellectual property rights.

That having been said, we acknowledge that infringements are unfortunately always possible. In these instances, we will investigate the situation and will work with both parties to resolve the issue.

What to do if you believe your copyright has been infringed

If you believe your copywritten material has been sold without your permission or that a title offered through EntertainOne violates your intellectual rights, please contact us immediately with the following information:

  • Identification of the rights that you believe have been infringed
  • Your full contact information
  • A signature from the individual authorized to act on behalf of the owner of the rights
  • Location where the offending material was purchased or discovered
  • A statement that you believe the alleged use of the material in question is not authorized by the rights owner, the rights owner’s agent, or the authorities
  • A statement that all attached information, as listed above, is accurate and that, under penalty of prosecution, you are authorized to act on behalf of the owner of the rights that are being violated.

What if you’re accused of infringing on an owner’s rights?

We are always anxious to resolve issues fairly, and will work with you and the complainant to try to reach a resolution. We will ask both parties to produce proof of ownership. At this point, we may hold the title back from sale until the claim is resolved.

If we receive proof that your title is violating the other party’s intellectual rights, the title will be removed from sale and your account will be frozen. Customers who have purchased the title will be informed of the situation and asked to return the title to us. There is a $10 charge to you for each returned title.

NOTE: If you are in violation of another person’s intellectual property rights, you may also be liable to pay them damages. As per the indemnification in our Membership Agreement, you will be responsible for any costs incurred by EntertainOne that relate to your violation.
